Pregnancy Today's Advisory Panel Answers:
How safe is home birth, and is it legal?

Question

How safe is home birth, and is it legal?

Answer

As safe as life is! Home has been the normal place to give birth everywhere in the world and in almost every time in history. If it were not safe, we would not be here. Homebirth is common in many nations with better infant mortality rates than the US. Most homebirth midwives carry the same emergency supplies and equipment found in birth centers, and are fully trained in their use. No location can guarantee a perfect risk-free outcome, not even the most advanced medical center in the world; however, a woman of ordinary good health will face as few or fewer risks at home as she would in a hospital or birth center.

"Home birth" is legal, since no one can force you to go to the hospital. Midwife-attended homebirth is legal in most states, although state laws governing midwives vary greatly. Homebirth attendants are required to follow state laws regarding filing birth certificates, laboratory testing, and record keeping. The popularity of homebirth is growing; in fact, many insurance companies will now reimburse for midwife-attended homebirth. Check with your insurance carrier.
